Agriculture and Food

The Agriculture and Food commodity requires knowledge of special paperwork and handling requirements whether importing or exporting. The Food and Drug Administration (FDA) and US Department of Agriculture (USDA) are the lead agencies for this commodity but work in tandem with Customs and the Bureau of Industry and Security (BIS) for export.

FDA requires all items they consider to be food to have a Product Code prior to allowing entry into the US. The Product Code Builder Application will guide you through an easy, user friendly selection process. It will assist you to locate and build a product code. By building upon the code portions you select, the application will provide you with valid choices for each of the five components of the product code (Industry, Class, Subclass, PIC, and Product). You can complete the Application online by clicking on Product Code Builder. Then, submit the application to your Byrnes contact for a suitability review. Alternatively, Byrnes can complete the application on your behalf for an additional charge that is based on the complexity of your products.

Perishable products are time and temperature sensitive. Registration with FDA of all entities handling the import of these items is mandatory along with Prior Notice filing before the goods arrive at a US Port of Entry.

Other regulatory agencies inside and outside the US may also be involved with this commodity group. Along with recent headline risks, Free Trade Agreements and this commodity group are intricately linked. The long awaited Korea Free Trade Agreement (KORUS FTA) may have cleared a hurdle toward a signed agreement. This kind of agreement provides American agriculture with improved access to other economies and eager consumers.

Various US states are key suppliers of valued agricultural commodities to overseas markets and consumers. California alone supplies 80% of the world market for almonds and is the largest agriculture export market for the United States.
